The good news is the Obama administration has actually done the right thing by allowing Plan B, the emergency contraception, to be sold over the counter. Of course the administration only did this after first taking the almost unprecedented step of overruling the FDA’s recommendations and then losing multiple court cases fighting this policy. The Obama administration dropped its long-standing opposition to over-the-counter sales of a controversial morning-after pill Monday and decided to permit consumers of any age to buy Plan B One-Step without a prescription.
In papers filed in federal court in New York, government attorneys announced that the Food and Drug Administration and the Department of Health and Human Services would remove age and point of sale restrictions on the emergency contraceptive, pending approval by U.S. District Judge Edward Korman.
It is important to remember there was zero justification offered by the administration for originally stopping this recommendation that wasn’t political, sexist or paternalistic. The idea teenage girls might be too stupid to follow the most basic instruction was ridiculous and insulting. It is the same danger that has always existed for almost any product sold over the counter at a drug store.
The Obama administration didn’t so much choose to do the right thing as they were forced to do it when the realized they had run out of other options. To steal from the famous Churchill quote, you can count on the Obama administration to do the right thing after they have exhausted all other possibilities.
