The Supreme Court has now published the audio and transcripts of this morning’s Hollingsworth v. Perry oral arguments. The case is about California’s 2008 Proposition 8 which banned same-sex marriage in the state. You can find them here.

The two main questions of the case are whether or not the petitioners lacked standing and whether banning same-sex marriage is unconstitutional. The state of California refused to defend Proposition 8 so proponents of the ballot measure intervened as defendants. There is a real chance the Court could punt on the issue by concluding the defendants lack standing, but trying to predict how the Justices would vote based on the oral arguments often ends up being a fool’s game.
