Dan Choi, Bill McKibben and Scarecrow have now spent two nights in jail courtesy of the DC police for an offense that routinely equates to a parking ticket. According to Ted Glick over at Grist, the orders to hold them came from “higher up”:
In negotiations with the police prior to the action that began on Saturday, the police were very clear that what would happen after people were arrested was the vast majority would get what’s called “post and forfeit,” where you put up $100, get released from jail after several hours, and you don’t have to come back again. It’s basically like a traffic ticket.
But this is not what they did. Instead, after arresting the first day’s 70 people, they decided to hold most of them, all those not from within a 25-mile radius of Washington, D.C., in jail until a Monday afternoon arraignment. This works out to 48 or more hours in jail before being released.
Why did they do this? One of the police officers told one of the action’s lead organizers that the decision to do this was made “at a much higher level than mine.” Four separate police officers told organizers that it was explicitly to discourage other people from taking part in actions going forward. Personally, I believe this had the hand of the Obama administration all over it. They want this action to fail so as to relieve the rapidly building pressure on them to do the right thing and deny the Keystone XL permit.
I agree that there is no way the DC cops, or the Park Police, decided to do this on their own. They released 8 of the 65 people arrested on Saturday (including me) because we live in the DC area and they had an overcrowding problem in the DC jail. Which is why they also released all 45 people who were arrested yesterday. But their “solution” managed to keep Bill McKibben incarcerated for two days, significantly disrupting the leadership of the action.
I have no doubt Obama wants to give the oil companies what they want and approve the pipeline. Why wouldn’t he? The guy who took his daughter down to play in the gulf and has done nothing to hold BP responsible for the Deepwater Horizon spill is not going to stand up to the oil companies at collection election time.
But there’s also another election component to factor in. As Neil Munro notes this morning, “Obama has maintained high support among some important groups that respond to liberal arguments, including gays and environmentalists.”
Obama wants and needs the support of liberal environmentalists in 2012, but he doesn’t intend to do anything substantial for them, like blocking construction of the pipeline. If he did, he’d certainly say so before two weeks of protests began at the White House. So just as Bradley Manning was stripped naked and forced to stand in front of guards for inspection after people began protesting about his conditions, the leaders of the Tar Sands protest were held in DC jail for two days in another moment of authoritarian overreaction.
I spoke to the lawyers last night about the conditions in the jail. The women who had their sweaters and jackets taken from them were forced to sleep in thin summer garments appropriate to 90 degree heat in a very cold cell on the floor with no blankets. The styrofoam blankets that had been given to us by the Park Police were confiscated before they were transported to the DC jail. There is no doubt that the organizers were deliberately lied to so that the protesters would not be prepared, part of a conscious effort to make everyone as miserable as possible.
I’ll be at the DC courthouse for our arraignment at 2pm today, along with Scarecrow, Dan Choi, Bill McKibben and the rest of the Tar Sands 65. I’ll be posting about it as soon as I can. It will be wonderful to bring Dan and Scarecrow home.

UPDATE: Charges dropped against everyone but Lt. Dan Choi, Tom Weis, and Dave Schleisinger of Vets 4 Peace. They’ll be brought up for arraignment shortly.
Please come to DC and send a message to the President that he cannot capitulate to the oil companies and approve the tar sands pipeline without consequence. Let him know that people who care about the environment, from conservative Nebraska ranchers to urban climate change activists, oppose this rapacious act of oil company greed.

Jane, I would not dispute your framing here (the authoritarian smackdown to improve Billion Dollar O’s re-election prospects), but I would argue that this is less about O than it is about natural resources and the deployment of our military to secure them.
In short, this is about zero-tolerance for protesting either Big Oil or DOD.
If successful,such protests would pose a real threat to the oligarchy. There are real economic benefits to be gained by scaling back DOD and moving away from oil (lots of other benefits, too, but lets focus on the resource the oligarchs care about… money).
That’s why they are beating up so hard on the guy in Colorado (my apologies for forgetting his name at the moment), and on Dan, and on Bill.
You guys are going to the heart of the oligarchy. The public is on your side, so the PTB need to nip this in the bud before they lose control of the situation. I think it is actually too late for that. They just haven’t figured it out yet.

Totally agree that this is the larger picture. At the moment it’s just up to Obama whether the pipeline goes through, and only him. He can’t hide behind Republicans or some other process argument. If he approves the pipeline, he has to own it.

One lousy spill could destroy the largest aquifer in the country affecting millions of people’s ability to get potable water.. And the farmers just think of all those farms that would have to be abandoned if their source of irrigation water was disrupted/destroyed and the lost food production… Well on second thought maybe that IS the intention all along, ya know disrupt food availability and watch as the people start to starve and then riot!! With respect to Choi, I think part of the problem for the WH is that they can’t arrest and charge him for an allegedly serious offense a few months ago, then turn around and let him go this time. That would make a mockery of their case for the previous instance. Although letting 65 other people go hardly insures a rock-solid foundation for any case against Choi.
BTW, don’t you just love it when the get to arrest people, keep them in jail for two days, and then say, “Oopsie, my bad, no harm, no foul, scoot along now?”

Obama appoints people who will make decisions for him, and in fact, sometimes people are appointed for him–decisions that he will agree with, but he is always at least one degree of separation from all decisions that come out of the White House. That way, if they go south, he can always blame an underling and fire them.
I agree with your analysis of this. This is going against the heart of the Oligarchy, and as several who post here regularly have pointed out, we passed Peak Oil some time ago. I suspect that there might be some fear in the Oligarchy about access to their favorite “drug” of choice, Oil. It’s their money, honey, and going after that is a big No-No.

The Sierra Club sold out long ago. They are not environmental organization any more, they are a big business. I quit them about 15 years ago when I figure out they just wanted numbers for members to have political power. And not power for the environment. The Sierra Club is to the environment as AARP is to old people. They are with you to make a buck and, of course, have power.

People need to incorporate his/her self to get the rights, privileges, and benefits of corporate person-hood. A corporation has never been incarcerated.

Just finished reading re: Keynote XL Environmental Impact Statement. A lot of the same BS that plagued Macondo and the Obamadmin playing the same games: E.g., Lifting outdated analysis, inadequate examination of potential dangers, using replaced metrics, … WOW! I’ve done a lot of environmental analysis and helped write parts of NEPA amendments and regs and this stuff just stinks to high heaven! I would imagine that this has been done but has anybody filed suit seeking an injunction? Not that that would change anything at this point but it might help bring more light. The action is absolutely necessary. I’ll even add a worst case scenario: The New Madrid fault. Won’t happen? Right. I have one word for that: Fukushima. And, it won’t have to be a series of monster quakes either.

How does one go about filing and injunction against a foreign nation or our own for that matter?
If it can be done, I’m all for it. Not only an injunction to stop progress, but to also release all communications, money backing, investors, and any other facts.

I used to be a prosecutor in that court (US Attorney for DC).
Most probably, the prosecutor simply dropped the charges.
The prosecutor is, of course, part of the Executive (DOJ) so there doesn’t need to be any judicial action.

Only 3 charged. Dan Choi and David Schlesinger had unresolved cases for other demonstrations, but Tom Weis only had previous arrests for protesting that had been resolved.
We were all originally charged with failure to obey, but everyone except these three had charges dropped. The judge said failure to obey carries no jail time, so Dan ET al spent two nights in jail and were brought to court in handcuffs and leg irons just because they wanted to be dicks.
The government is also bringing a charge of incommoding against the three which carries a penalty of up to 90 days in jail and $500. They also received a stay away order from the white house sidewalk area.
Everything seemed designed to discourage any further protest in front of the White House.
It’s amazingly encouraging that the Times chose to editorialize on this. Eventually, those snooty bastards might even acknowledge who is behind the protests. Not holding my breath, however . . .

Basically, you go to a judge (federal in this case) and you say: “This EIS is inadequate for the following reasons…We need more time given the severity of the potential consequences. If the judge grants an injunction that puts the project in jeopardy. Mega construction projects like this require timed financing. Delays cost major $$ and scares investors, et. al. As far a a foreign country goes, the project runs right through the middle of the US. We have absolute legal jurisdiction. I am not a lawyer but worked with them a lot on such cases as an environmental advocate.

I spent a lot of Saturday mornings as a kid sitting on the short wall that fence rises from feeding squirrels, until Eisenhower had them poisoned cuz they kept messing up his putting green on the other side of the building.

It is a preposterous idea to pipe oil from Canada to The Gulf in Texas. The chances of environmental catastrophe are extremely high. Refine it at the closest Pacific or Arctic waters–and or don’t fracking go after it. Big Belt Buckles in Texas want it all–no matter how much it may harm the nation. How much wildlife and environment does Obama and Salazar want to continue to kill? Obama talked a lot about the environment in all his campaign lies. Obama–the great friend of nature. No, the guy could not care less.
All of it. They’ll all be dead by the time the effects are fully felt so they don’t give a rat’s ass.

Heavy sigh but a happy one. :) The court of public opinion is the best venue for this. I’m wondering if the Nov. 1 deadline was put there to backstop against legal action for a deficient EIS? While the Draft EIS official comment is closed. The final public vetting is still open. Used to be that every citizen had standing under NEPA. Subsequent decisions and amendments may have altered this. Any attorneys care to comment? I’m from the technical side. One thing for certain. This BS is against the intent of Congress in establishing NEPA. Maybe that’s why they wanted Congress’s fingerprints on the Nov. 1 date?

No matter what he says and does, no matter how bad, they won’t quit fawning over him. It’s infuriating. They just think he’s weak, they defend him. He can’t get rid of them, and they’re ruining everything. They’re making it so he can’t convince the Reaganites that he’s really one of them. Because of the liberals, the country clubbers don’t get it! They still accuse of being a socialist! Assassinations, wars. What does he have to do to prove himself? Nobody understands him. Maybe if he throws the environmentalists — luckily one of them is a prominent gay — in jail! Throw them all in jail!

Words fail, DW, my blush will have to suffice lol. On a very serious note, and fully understanding your praiseworthy commitment to non-violent evolution, when I consider the character (maybe I should say “lack of . . .”) of the forces we are up against, I have little doubt they will turn to force before they yield in any meaningful way. I fear that if we stay committed to the protest path, we will inevitably be forced to at least have the philosophical discussion I used to urge on the community, i.e., what to do as a moral actor who insists on freedom when peaceful protest just results in more, and more violent, oppression. There are no clear, easy, painless, or completely satisfactory answers to that question, unfortunately. But, to the extent that civil disobedience depends on arousing feelings of shame in the oppressor, I think we are wise to recognize how low corporations score on that metric. Can’t have shame without a soul. And only “fleshies” have souls.
It is a very puzzling way to build and expand upon the 2008 coalition he assembled: piss off and alienate those who supported you in hopes of engaging the interest of those who would never, ever vote for you because you’re a Muslim, Kenyan, Socialist, Manchurian candidate who hates America and white people.
These guys who ran his campaign (which in the general election couldn’t lose, but props to them for their nomination campaign against Clinton) think they are effin’ geniuses because they beat Old Gluehorse after he picked Palin and declared the American economy fundamentally sound.

In my opinion constructive criticism and constructive opposition if always good for future and society.
In my opinion Sister Jane and her team is doing that exactly in the traditions set by Thoreau, MLK, Gandhi, Mandela etc. and they are getting into a select and honorable group by doing that.
Let me give an example:
Just not so long ago grand pooh-bahs of our MSM thundered to sell the idea of nuclear energy and berated US that it fell from leaders to laggards. Only on few blog sites such as FDL I saw opposition based on honest & logical arguments. Most of the places it was parroting as usual. But anyway US took pooh-bahs advice and started making grand nuclear plans for future.
Then Fukushima happened.
These grand pooh-bahs of MSM kept quiet and picked on another topic to pound on definitely not SEC document shredding but something more meaningful and near and dear to common folks.
What Jane and her fellow activists picked on is some serious damage to environment which will take thousands of years for earth to heal. She and her fellow agitators are trying to salvage current Presidents legacy by their action because the future generations thousands of years from now will blame this administration if this totally avoidable damage is done. Similar to as we are thankful for congress more than a century back in establishing worlds first national park for us to experience it as they have done.
What Jane does is hardly constructive. As usual, she’s taken a perfectly good and righteous protest and made herself the center of attention. This doesn’t advance the cause any more than donations to FDL Action have advanced any progressive candidates.
