Today’s vote, will determined whether Progressives are voting the wants and desires of their respective “constituencies.” On the other hand, will the progressives be voting their Progressive “credentials.”

Other than War-Making and appointments to the SCOTUS, ideology does not reign supreme among Democrats. And War-Making has been called into question, given the Democrats penchant for Iraq and Aghanistan.

Of course, from my perspective, and that being I am a “racial and ethnic” and thusly, engaged in the Democratic Coalition, and given that LBJ’s Great Society is my “gold standard” not much has been forthcoming from the dominant partner of this coalition, and further, being “critical” of all Democratic leaders is my normal fare.

With this context, it is astonishing that apparently nobody has bothered to read the text of Public Debt Law of 1941 itself, embodied in 31 USC 3101, which is what codifies a national debt limit. That law states that

“The face amount of obligations issued under this chapter and the face amount of obligations whose principal and interest are guaranteed by the United States Government (except guaranteed obligations held by the Secretary of the Treasury) may not be more than [some arbitrary huge number] . . . ”

Please take careful note of the words “EXCEPT guaranteed obligations held by the Secretary of The Treasury”. By undeniably clear law as passed by Congress, such obligations are NOT constrained by any so-called debt limit. Now all you have to do is run your finger down to the very next section 31 USC 3102 [Bonds] and you will read

“With the approval of the President, the Secretary of the Treasury may borrow on the credit of the United States Government amounts necessary for expenditures authorized by law . . . ”

By this section Congress gives the President the EXPRESS, inherent and unilateral authority to direct the Secretary of the Treasury to incur obligations to cover all expenditures authorized by law, which is to say the sum of the appropriations bills Congress has already passed. And as we have just so clearly demonstrated such obligations are immune from any so-called debt ceiling limitation. Surely there is some White House attorney smart enough to figure this all out as we have.

The President must invoke this authority now, as he is fully empowered to do by 31 USC 3102. And then Congress needs to get serious about raising the revenues to pay its bills, and not just on the backs of poor people.

Seems to my reading the President already has the authority to raise the debt and payy all Bills already passed by the Congress!!! Please sign the petetion!!
This as has been said over and over is all a made up crises to give the American People a dose of the “SHOCK DOCTRINE” for the benefit of the rich… Lock and Load folks all hell is going to break out when they cut all the social safety nets including Social Security that you have paid into (at much higher % than the rich) all your life. When you call your congressperson, remind them that there is NO actual possibility of default because of the Public Debt Law of 1941 31 USC 3102. It is a later law than the debt ceiling law (WWI vintage), and thus takes precedence. The law gives the president the power to ask the Treasury Sec. to cover all “expenditures authorized by law…,” i.e. appropriations bills that have passed. According to this law it is the president’s duty to ensure that the government doesn’t default on its lawful commitments. So it will be Obama’s *duty* on Aug. 2 to ask Geithner to start paying all commitments, not just selected ones. So talk about a default is complete BS — typical scare tactics. Just had a nice talk with a young man in the Congresswoman’s office, even after I explained that I was not a constituent. He tried to explain to me that this bill does not “cut” Social Security and Medicare. I explained to him about the “Super Congress,” and the “chained CPI” and that it most certainly will. I also explained that I would be donating to a primary of the Congresswoman if she voted “yes.” At that point he claimed that he wasn’t sure how the Congresswoman would vote. I doubt that, but the conversation was very civil.

Blumenauer: His staffer said Earl was “reluctant” to vote for it. Said Earl was unhappy about the entire process. Used the term “hostage-taking.” Unfortunately, Earl has made semi-recent comments to The Oregonian about the “need to cut entitlements” and mentioned Social Security. So I’m not optimistic about him, either.

I did not mention the SuperCongress specifically. Just the debt deal as a whole.

I called my rep-for-the-moment David Wu (OR). The staffer said he did not indicate how he would vote, but that she would relay any message. I acknowledged his “last vote” and his problems, and asked him to exit gracefully by voting this deal down, since it would cause great hardship for me and millions of other people.

I also went to his office in Portland personally on the Day of Action about 12 days ago, right before his scandal broke, and delivered a letter to a staffer there.

Under the circumstances, I can’t help feeling locals here have about .000001% leverage with Wu, even less than the .000003% we have with any member of Congress. I’m probably overestimating.

Chicago Tribune reporting as Breaking News (http://tinyurl.com/3t9g38y) that Joe Walsh and Jesse Jackson Jr. intend to vote against the latest debt ceiling deal.

Jackson gets it right regarding the Super Congress:

“With regard to raising the debt ceiling, Democrats were left with two raw choices: (1) a job-killing default according to Boehner; or (2) a job-killing austerity from my perspective. And who will suffer the most under the apparent winner of the job killing austerity plan? Those who are already suffering the most under present conditions: African Americans, Hispanic Americans, Asian Americans and women. Thus, in future negotiations — unlike the current negotiations — fairness demands that these communities be able to speak for themselves through their representatives. Waiting on the outside of the negotiations for someone to bring us the word about our interests from the inside would be a shameful and unacceptable throwback to the past.”

Earl Blumenauer (D-OR) – “I spoke with Ryan, gave my name and identified myself from Portland, OR in US Congressional District 3. I said I oppose a “Super Congress” and that I would not vote for Blumenauer if he votes for this as this is unconstitutional. I also stated I wouldn’t vote for Blumenaur if he votes to cut Social Security and Medicare. He said that it was crazy around there and that I was preaching to the choir He did want to know how the term “Super Congress” came about.” 202-225-4811

This indicates to me that calling to oppose the “Super Congress” is a mistake, because it misses the point of what we’re all purportedly opposing. It tells Congress that we’re all up in arms about some procedural trickery rather than about the unnecessary cuts.

I called Merkley, Wyden, and Wu’s offices to tell them, “The President has the legal authority to circumvent the debt-ceiling. Oppose this terrible and unnecessary austerity deal, and force the President to take action on his own.”

This is also completely inconsistent with other issues FDL has tackled where the position was basically, “Nobody gives a shit about Congressional procedural rules.” Raising hell about the “Super Congress” rather than specifically the issues the “Super Congress” is set to address only tells them that we do actually care about arcane procedural rules.

$22 trillion Social Security surplus revealed on C-SPAN

When Peter Coy, the Bloomberg Businessweek Economics Editor, appeared this morning on “Washington Journal,” he brought along a chart for his discussion of the magazine’s cover article, “Why the Debt Crisis is Even Worse Than You Think.” But, the chart, purported to show a national fiscal gap, did not match Coy’s talking points. As Coy concluded commenting that cuts would be needed to Social Security and other entitlements, C-SPAN moderator Susan Swain pointed out that Coy’s chart showed a long-term surplus for Social Security of $22 trillion. Coy confirmed as accurate her interpretation of the chart and, after some stumbling, admitted that, “The trust fund is not the crucial issue.” Indeed, his own figures show that it is not an issue at all. So, why did he continue to insist that Social Security cuts are needed?

In the middle of this afternoon, I called Rep. Van Hollen’s Capitol Hill office and asked to speak to a staffer regarding budget, Social Security, Medicare, or Medicaid. The receptionist went to find someone, then came back and said he was asked to take my message. After explaining my position, I asked Rep. Van Hollen’s plans on tonight’s vote creating a Super Congress. The receptionist explained that the Representative does not want to balance the budget on the backs of the weakest in our society. I said, yes, but how does he plan to vote tonight? The reply was that Van Hollen had not decided yet.
