Democrats should be concerned about their path forward with health care reform. The current Senate bill is very unpopular as a result of bad policy decision on the part of Democrats combined with poor messaging. Taking out the popular public option — while fighting to keep the very unpopular individual mandate as well as the excise tax on benefits — was an extremely stupid political decision. If Democrats choose to pass health care reform they should be focused on how to make sure the bill has as many popular provisions as possible and as few unpopular provision as possible. What they should not worry at all about are Republicans senators, like Lamar Alexander (R-TN) spewing nonsense about the legislative process.
Alexander said that Democrats using reconciliation would be a “political kamikaze mission” and that would basically be the “end of the Senate”.
It would turn the Senate, it would really be the end of the Senate as a protector of minority rights, the place where you have to get consensus, instead of just a partisan majority.
I’m not going to address the factual absurdity and completely hypocrisy of his statements given that Republicans have used reconciliation repeatedly because the American people don’t care about Senate procedure (others have already covered this). It is not just that American don’t care about Senate process; they don’t even know what it is. Most American don’t know what cloture means and how it works as related to the Senate. It’s doubtful that as many as one in 10 Americans could name two bills that passed using reconciliation; nor could many citizens tell you have many votes big bills like Medicare, SCHIP, or No Child Left Behind got in the Senate when these initiatives were created.
It is too late for Democrats to worry about Republicans screaming nonsense about this or that procedure. They have known for months they were not going to get Republican cover and should have prepared accordingly. Republicans will attack Democrats regardless of what they do – they are acting as an opposition party, opposing absolutely.
If Democrats do pass health care reform what the vast bulk of Americans will hear and/or probably remember is that at most Democrats passed a health care bill with A, B, C, and D. Exactly what these three or four things are is critical. If A, B, C and D are popular, it’ll be a win for Democrats. A win could include closing the donut hole, a public option, a ban on exclusions of pre-existing conditions, tax credits for small businesses, Medicare buy-in, employer mandate, etc. Any of these things are popular and passing them will help the public’s perception of Democrats. But if the items A, B, C, and D included in the health care bill are unpopular, Democrats will be crushed in 2010. For example things like individual mandating forcing you to buy private insurance, new taxes on your health care benefits, secret deal to drug companies, cuts to Medicare, etc…these would be very bad. At this point Democrats should count it a win if people remember the bill as being a mix bag of good and bad provisions.
Politically the sole thing Democrats should be focused on is not process but defining what A, B, C, and D are in the public consciousness. They should make a point to strip anything big and unpopular they can like the individual mandate, the excise tax, and the Cornhusker kick back; they need to send strong messages to the public about adding in big popular provision like a public option, Medicare buy-in, and drug re-importation. Defining what are the three or four things people remember being in the health care bill is what will make or break Democrats — not insider baseball talk about Senate procedure that most regular Americans don’t know about, don’t understand, or don’t care about.

Brother Walker, your last two offerings are two of the best information and analysis postings we’ve had here since this little community got franchised…you get a silver star on your Norskie Medal of Citizenship! What you have done here is define the intersection of good politics and good policy and those who have influence over the process, those in the leadership in both houses and the White House know this. So the truth of your post begs the question: Haven’t the elected leaders in Democratic Party already thought through both the process and the product of the reconcilliation mechanism that will be used?
It’s kinda like what my youngest daughter has been learnin’ about the graduate schools for which she’s interviewed: They need her, more than she needs them. In the end, if the Democrats are to survive in leadership beyond 2010 they are not only gunna hafta get somethin’ done but get somethin’ done that works immediately for the people. It’s simple.
This is why I’m convinced that Rahm’s triangulation gambit is gunna fail this time around.

What VP Biden says are the rules of the Senate are by definition the rules of the Senate. If Biden follows past rules he will allow just about anything that scores on a CBO analysis as saving money, and which is not a major policy change (post Senate Bill passage by House there is not much left that is major policy change – and besides “major” is decided by Biden – so lets go for Medicare buy in from age zero).
The only procedural hang up is the rule that unlimited Amendments to the recon bill are allowed – each getting 20 hours of debate. If the GOP get crazy with the number of amendments the recon rules will need to be changed – by a 51 vote majority of course. But it is nice that under the current rules someone could Amend to a single payer – and if Biden rules not a major policy change, the Senate will be forced to vote on it. Likewise I am sure Public option will be forced to a vote.

They’ll also have to include some floor speeches about when the GOP passed tax cuts via reconciliation, and what that has done to the federal deficits.
Speaking of which, they have to control health care costs, as a means to get a first whack at the deficit.

Alas, Lamar Alexander does indeed speak nonsense. One can only wish he knew what he was talking about, and that the Senate could actually be put to an end so easily.
That body is arguably the most undemocratic governmental institution on the planet (and yes, I AM taking into account the Russian politburo).
Speak up for a new constitution, parliamentary democracy, and an enlarged unicameral legislature. Decades of Senate resistance to change have left us with problems that will never be solved within our current structure of government, and can no longer wait for these egomaniacs to get up off their thumbs.

I’ll have to check some facts but I think I remember from high school history classes (back in the early 70′s)that our Senate is purposely set up to work just as it working today as regarding (2) senators for each state — the House is based on representative population. I also remember that the state population in 1790 was skewed big (Virginia)to a couple of smaller states to about 13 times in favor of Virginia. It has worked for over 200 years and you want to change our great democracy to be able to shove a piece of shit legislation down this country’s throat — give me a break !!!

correction: it wasn’t just a “STUPID” political decision, it was a VERY CORRUPT political decision, the treacherous Mr. Obama and his White House Chief of staff (rahm emanuel) had ABSOLUTELY NO INTENTION of doing A DAMN THING to make Health Care more affordable to millions of health-care desperate American families, from DAY ONE Mr. Obama was concerned only about soaking up CAMPAIGN BRIBES, er, “donations” in return for BILLIONS of dollars of sellout “rigged bids” to Big Pharma, and CONTINUED MONOPOLY PRICING for Big Insurance companies and their hired “economic hit men” lobbyists.
Alexander was a good governor. It is miserable to see what has happened to him.

Sadly, the press is buzzing that the House WILL be forced (how I don’t know) to pass the Senate Bill before the Senate Shenanigans begin for reconciliation . . . but if the House DOES pass the Senate Bill, I think the worst will be the result for the people and a huge loss at polls for the Dem’s in ’10 and ’12.

Bunning really made a fool of himself today. Apparently was at ABC and when they asked him to answer some questions, he flipped them off and got on the elevator. An ABC reporter was on the elevator with him and Bunning kicked him out saying “this is a senators only elevator.”
Alexander is talking nonsense, but nonsense north-north-west. It’s nonsense with a purpose. He says he’s worried about the Senate achieving consensus rather than engaging in partisanship while he and his Republican buddies are engaging in partisanship. Republicans aren’t interested in protecting minority rights. They’re interested in hurting Obama politically (playing partisan politics) and they’ll doing so regardless of how reckless and regardless of how much the Democrats have already compromised in ordert to appease Republicans who aren’t interested in bipartisanship, compromising, being appeased, or what’s in the best interests of the country.
The only thing more embarrassing than having Alexander as one of my Senators is watching Democrats do such a lousy job of pushing Republicans aside to do what’s right, not to mention popular.
The choice of voting for or against Obama’s Obamanably Shitty Health Insurance Reform Bill (OOSHIRB) is like being forced to eat live cockroaches or fresh dog shit.
Can’t seem to get a good acronym going for the damn thing, but at least the menu is unsophisticated and unpretentious. Subdued white trash favorite side dishes adored by senators doing lunch in the senate cafeteria.
Here’s the real problem: everyone knows the Democrats have the largest majority in years and years. They are completely in charge of everything. If they allow the Republicans to carry on like this, they are seen as weak and rightly so. Even though the Republicans clearly do not deserve it, people will choose wrong and strong over right and weak every time. It’s the law of the jungle, strong always wins whether it’s right or wrong. If it’s wrong, it takes all of us out with it but it doesn’t care and neither do we. We just want someone to lead us. The Democrats need to stop fretting about process and just run the Republicans over with their substantial majorities in both houses. Senator Reid should call the Senate into session and not adjourn until Bunning and his colleagues either relent or collapse, hopefully the latter. But he places his precious process and collegiality and the needs of Senator Bunning and others that refuse to stop him to eat and sleep and watch basketball over the needs of the rest of America. IANAP (I am not a parliamentarian) but the Senate rules don’t allow for a “real” filibuster (ala Jimmy Stewart in Mr. Smith goes to Washington). When the requirement for overcoming a filibuster was changed from 2/3rds to 3/5ths they also changed it from Sentors present and voting to Senators. I belive that wWhat that means is 2 opposition Senators (one to object to unanimous consent and the other one to keep the first one awake) are all that have to be present to keep a filibuster going while all 60 votes to end it have to be there.
I haven’t had a chance to read all posts here, but I haven’t yet seen anyone get the real point of Alexander’s statement. What he said, which I totally agree with is that if reconciliation is used on this item, Republicans will feel no compunction whatsoever to send everything through on reconciliation that they can’t get with 60 votes.
If something this big is done that way, there will be no bar to anything else being done similarly.
Considering that there is some chance of the GOP taking the Senate in November, that is not a good prospect.
The GOP will have an open door to the many things they have wanted to do over the past 16 years but were not able to. And, if the election is 2012 does not go the Dems way, then katy bar the door.
By now, you have seen many, many videos of top Democrats railing against the GOP use of reconciliation. And they were right. And the GOP should not have used it.
What seems more interesting today is Pelosi’s statement on camera that a much smaller bill is being put together. WHAT could that mean?

Jon Walker is right, of course. Dems need to focus on how the bill is perceived after passage, not how it passes. The perception of the bill itself will determine whether the passage of health care reform is a winner or loser for Dems, not how the bill passed, about which the American public coudn’t care less.
Unfortunately most of the establishment Dems don’t realize this because they’re suffering from battered wife/Stockholm syndrome. They’re working in a town, namely Washington, which has been marinated and soaked in right-wing talking points since the time of Reagan. These talking points echo from the very walls of those marble buildings in a deafening, mind-numbing and constant din. Because of that, the establishment Dem party remains profoundly traumatized and confused, with the result that they have yet to properly understand on which side their political bread is buttered.
So if those right-wing walls keep echoing with the din of “can’t piss off the Republicans too much or you’ll lose power”, most establishment Dems instinctively recoil, cringe and fold, with the result that they hesitate to use reconciliation, they hesitate to pass a public option, etc. etc.
It is truly amazing to see all these so-called smart savvy politicians so completely lose sight of their own requirements for self-preservation, and to be so completely buffaloed by the din from the local echo chamber. What children!
