The Senate Democrats had a conference call with reporters to extol all the great “improvements” they have made to the bill. They listed three improvements they wanted to talk about:
The manager’s amendment to the bill, introduced yesterday, strengthens key reforms that benefit consumers like the medical loss ratio, patient’s bill of rights protections, and non-profit insurance options overseen by the Office of Personnel Management.
The first improvement is good idea, but very weak. It also leaves a loophole you can drive a truck through on the issue of medical loss ratio. In the second “improvement,” I believe they were referring to the closing the ban on annual limit loophole that Harry Reid put in the merged bill. This provision was a top Obama promise all year, so fixing their mess (which they clearly lied about) is not something they should pat themselves on the back for. Finally, the non-profit insurance option overseen by the Office of Personnel Management is not likely to work. That is not my determination, it is the determination of the CBO.
The proposal would call on OPM to contract for two national or multi-state health insurance plans—one of which would have to be nonprofit—that would be offered through the insurance exchanges. Whether insurers would be interested in offering such plans is unclear, and establishing a nationwide plan comprising only nonprofit insurers might be particularly difficult. Even if such plans were arranged, the insurers offering them would probably have participated in the insurance exchanges anyway, so the inclusion of this provision did not have a significant effect on the estimates of federal costs or enrollment in the exchanges.
One good but weak idea with a serious loophole; one broken promise fixed only after Reid was caught selling out the Americans most in need; and one poorly thought out idea which is unlikely to work. If these are the three best “improvements” in the whole 383 page manager’s amendment that the Democratic leadership wants to promote, that should tell you something very important.

I’m curios; how much of the Senate bill was written by industry lobbyists? Is there anyway of determining that?
There’s no enforcement mechanism in the Senate Bill for stopping recissions. Reporters were told in a briefing by the Seante Leadership yesterday that they expect the states to do it:

“There will be no federal agency tasked with overseeing the enforcement of the bill’s rules. Rather, a Senate leadership aide told reporters in a briefing Saturday, individual states will police the new system.”

The problem with that is 1) they provide no money to the states to do it, and 2) states that already banned recissions have been unable to enforce it:
“The department’s director, Cindy Ehnes, told The Associated Press on Thursday that, when it comes to rescissions, the agency has had success in forcing smaller insurers to reinstate illegally canceled policies and pay fines, but Blue Cross is too powerful to take on.
“In each and every one of those rescissions, (Blue Cross has) the right to contest each, and that could tie us up in court forever,” Ehnes said of the approximately 1,770 Blue Cross rescissions between Jan. 1, 2004, and now.
“They have the largest number of rescissions, so as a practical matter for the department it does present some practical challenges that are different from a Health Net (of California) or a PacifiCare,” referring to providers who, along with Kaiser Permanente, have made settlements with the state to reinstate health care coverage.
That means that although Anthem Blue Cross has the highest number of alleged illegal rescissions, it may face the least regulatory consequence simply because of its sheer size, and aggressive legal defense.”

For this “private” system to work, we need a FEDERAL regulatory organization solely in charge of overseeing the private insurers. Wow, that’s a lot of bureaucracy, you say? Well, maybe we should just have god damn single payer!
Kate Randall over at the World Socialist Web Site has written a fine analysis of this awful healthcare bill and the Obama administration’s attacks on the Elderly and Disbaled, of which groups the Democratic Party supposedly “fights for.” As I have said before, I find the Obama administration led by Rahm Emanuel and David Axelrod and double-talker scoundrel Vice-President Biden and HHS Secy Kathleen Sebelius to be evil and sinister people. Evil comes in all different ways, shapes and forms. The evil exuded by the Democrats is less overt or obnoxious than that of the right wing or George W. Bush but it’s still as dangerous and sinister with its outcomes.
The Democratic Party’s disregard of the elderly and disabled must not go unnoticed or ignored and showing just how inhumane this bill really is, not to mention the Democratic women of the Senate who have sold out the pro-choice and Feminist movement. Yes, this includes Barbara Boxer, Dianne Feinstein, Patty Murray, Claire MacAskill, Barbara Mikulski, Maria Cantwell, etc. It’s obvious the Democratic Party want the liberal-progressive base to go away and not be heard from at all. This message could not be any clearer than it is tonight. Yes, the Democratic Party do not want liberals or progressives in the party and it is time everyone understand you will never get liberal/progressive policies out of these Democrats at all. Never!

Is there any way FDL Action could organize a net-roots campaign to recruit a senator to filibuster in order to prevent passage by Christmas of the current Senate compromise bill? T he incentive to a senator to do this should be evident to any one who observed Snowe, Lieberman, and Nelson during the past months. Their obstructionism provides them with instant celebrity status, fawning attention, White House invitations, etc.

Barbara Boxer?
One of my professors said she doubted the sincerity of Barbara Boxer but not on this issue. It was over her grandstanding after the 2004 failed of election of John Kerry when Boxer and the late Stephanie Tubbs Jones contested the election results in Congress.
Perhaps my former professor’s analysis of Boxer was spot on. I will have to send my former professor an email and tell her how correct she was regarding Senator Boxer.
It’s Barbara’s new — I’m as venal as Carly, except I’m a democrat – 2010 campaign strategy. She’s learned a Henny Penny trick or two from NARAL’s exploitation of Stupak’s Amendment in the house.
Boxer lost my support when she shilled for Lieberwhore’s independent campaign against Lamont in 2006, along with the Big Dawg, and his retinue of DLC asswipes.

No pure idea could survive the Senate. A single-payer system can’t get a vote. Republican ideas do nothing. What else did you really expect from this Senate except a complicated grab-bag of things which aren’t all so great?
I think they need to improve it as along as they can and then pass it. To spend this much time and not pass it would be a worse disaster for Dems and people who might benefit by the law.
Everyone calling it garbage just doesn’t get that the Senate can be hated, but not entirely ignored if you’re serious about getting reform done.

Boxer is up for reelection, but the Republican options are really ugly. If you can think of anyone to primary her, you might be able to get rid of her. I think that scaring her would probably be enough, though. She’s a “what do I have to do to look good person.” That’s why she did a great speech on the floor about Viagra but then voted otherwise when it wasn’t such a public occasion. If she gets enough flak, she might do a reverse Nelson, though. Just hurry. I’ve already let her have it as a California voter.

Actually, Obama voted against the Iraq war. That said while I think he shares a great deal of blame for how this was handled, he’s still the Executive Branch. Not the legislative branch. He should have chewed the asses of those responsible for writing the legislation. That’s Congress. If they don’t fix this bill or make changes to it later I won’t vote for any of the Dems. I won’t be voting for Republicans either. I’ll just stay home and watch them get their asses kicked by teabaggers.
Actually, no he didn’t. He was an Illinois State Senator at the time of the invasion and was not in the US Senate to cast a vote.
