ABC is reporting Reid is leaning towards putting a national, weak, “level playing field” public option with an opt-out provision in the merged bill. The move could be a result of real leadership, terror at the thought of losing his election, courage, profound personal conviction, incredible pressure from inside the caucus, necessity, or a combination of all of the above. Whatever the reason, Reid seems to believe he can get the 60 votes needed for cloture on a bill that includes a weak public option with an opt-out, even if the whole caucus would not end up voting for the bill itself:
Reid is now convinced that Democratic critics of the public option will support him when it counts – on the procedural motion, which requires 60 votes, to defeat a certain GOP-led filibuster of the bill. Once the filibuster is beaten, it only takes 51 votes to pass the bill.
This move would be in direct defiance of Empress Snowe’s decree that the bill must not have a public option, even with an opt out:
“Would [inclusion of a public option] be enough for you to vote against the cloture motion?” a reporter asked Snowe on her way off the Senate floor Thursday afternoon.
“On the public option? I’d say I’m against a public option, so yes,” Snowe said.
“But would it be enough for you to say, ‘I’m not going to proceed to this bill?’” the reporter pressed. Snowe nodded on her way into the elevator.
Snowe said she also opposes the opt-out version of the public plan, which would allow individual states to remove their residents from the federal exchange. “I don’t support that,” she said.
Sen. Max Baucus (D-MT) has spent months wooing Snowe by integrating her terrible ideas into the Senate Finance Committee bill. Even a few days ago, Baucus was pushing to water down the bill further to make it more to her liking. It’s being reported that, at the thought of losing his prized token Republican support for his bill, “Baucus went to DEFCON 1.”
Would Harry Reid really defy Snowe? As with all things related to Reid, I suggest waiting until there is solid proof before casting judgment.
Update: Baucus really wants to keep Snowe on board and/or kill the public option. TPM is reporting that he went to conservative Democratic senators to try to whip them up against the public option with opt out.
This, apparently, didn’t sit well with Senate Finance Committee Chairman Max Baucus, who is determined to keep Sen. Olympia Snowe’s vote.
“Baucus met with moderates this morning and got them nervous.” Or tried at least. Snowe clearly laid down her mark. And Sen. Ben Nelson (D-NE) didn’t seem particularly pleased. But of all the Senate’s conservative Democrats, none have yet rebelled.

Why are they so worried about Snowe? Can’t they do this without her? I thought they could.
I think they should work on Voinovich. This is his last year and I believe (from talking with many of Voinovich’s aides) that his door is open on the public option. He could go out the door having done the right thing for his Ohio constituents. It would put whom ever the Republicans put up to run for his spot in a much better position for that Senate seat.
The likely GOP nominee for his seat comes to the electorate with the incredibly impressive resume of “Bush Budget Director.” I can’t imagine Ohio voters falling for that kind of scam, unless votes get stolen.
Baucus needs to understand that none of us consider Snowe remotely important. His notion of bipartisanship is profoundly irrelevant to the American people. And if Olympia was from any other state, she’d be a Democrat.
It’s absurd.

Why doesn’t he tell Baucus and Queen Olympia to go screw – he’s putting up the HELP bill for a vote? After all, it was reported out first, and that was the rationale he used to put up Jello Jay’s crappy FISA bill first.
Reid’s crap bill or Snowe’s or Baucus’, so hard to choose, so hard to choose. This is all kabuki. The only reason there will be a weak or no public option in the Senate bill is because that is the way Obama wants it. Some of us have been saying this from the beginning.
Baucus understands that Snowe is an important tool for watering down the bill for Big Health. As are the ConservaDems. He wants the threat off a Democratic Filibuster to hang over both this merger sessions and the one with the House to get as meek of a bill as possible.
He knows what he wants to do, and the tools that usually work. The problem is that the game is getting more than a bit out of his hands at the moment. Harry and Rahm’s as well, and for a moment Nancy’s. She seems to have been the one who hipped to what the Progressive Caucus were up to, and the turning tide on the debate, faster than the rest of Leadership and the Admin.
And she’s played it fairly well recently, including some of her caution. She now has almost all of her guns lined up and probably just needs the last few votes to have it in hand. That in turn is forcing the White House’s hands, and Harry’s as most of the Dem Caucus in the Senate is starting to feel a little less willing to completely throw the PO under the bus.
Baucus wanted to be Man of the Moment. He screwed that up. Snowe wanted to be Woman of the Moment, with Baucus and the White House more than willing to let her. I thought at the time she was using her moment to damage the bill rather than to truley make a lasting moment in history of leading the bill where it needed to go. The irony here is that it looks like at the moment Baucus and the WH were annointing her Queen, the Progressive Caucus didn’t roll over and kept fighting.
If we end up with a considerably better bill that what came out of FiCom, the group of the moment will be the Progressive Caucus, and the Woman of the Moment will be Nancy for knowing how to use what they did you pull the bill back from the FiCom brink.

I really think 2 progressive Dems could flip this by making it clear to Reid: no public option, no cloture. POTUS has to pass something to keep from looking like a complete ass. Honestly. That is his worst nightmare. And it makes all the Corporate Dems look like…well, Corporate Dems. If Reid and co call their bluff, fine. Honestly, even with a strong public option, this is a shitty solution to providing universal coverage and keeping health care affordable. Go back and do it right in a few years. Who would have the guts to threaten a no on cloture? Sanders? And who else. This guy from Illinois? Kerry certainly has a safe enough seat. Maybe Whitehouse or Sherrod Brown?

I don’t think Reid caves. I think he’s very good at ‘allowing’ the repubs to win while professing that it’s only because he had no choice. Unfortunately, for him, people are wising up to that.

Not sure I follow you here. Doesn’t the House almost always defer to the Senate? Or…maybe better way of putting it, doesn’t the House usually cave to the Senate? A poster somewhere…here or TPM mentioned their relative weight in the merging process, and that legislation usually comes out looking a lot more like the Senate bill than the House bill. I’m not pretending I know anything about it, but interested to know more.
Portman will be running against Lee Fisher or Ohio Secretary of State Jennifer Bruner. All ready working for her
