Last month, Ryan Grim at Huffington Post uncovered an internal memo outlining the secret deal made between Baucus, the White House, and PhRMA. According to Grim,
Representatives from both the White House and PhRMA, shown the outline, adamantly denied that it reflected reality. PhRMA senior vice president Ken Johnson said that the outline "is simply not accurate." "This memo isn’t accurate and does not reflect the agreement with the drug companies," said White House spokesman Reid Cherlin.
After completing my preliminary reading of the Chairman’s Mark of the Baucus bill, it appears that Baucus has followed the deal outlined in the memo quite faithfully. Baucus’ bill would increase the Medicaid rebates from 15.1% to 23.1% (page 53). It would provide Medicare part D patients in the donut hole a 50% discount of brand name prescription drugs (page 122).
In accord with the internal memo, the Baucus bill does nothing to change current law regarding drug re-importation from cheaper countries. It does not contain the Medicaid/Medicare dual eligibility rebate promoted by Henry Waxman. It does not allow Medicare to directly negotiate drug prices which was added to House Energy and Commerce committee bill. There also appears to be no change to Medicare Part B in reference to pharmaceuticals.
Baucus bill differs from the memo in only two points. There does not appear to be any change to current law regarding follow on biologics, FOBs. The Baucus bill also imposes an annual fee of $2.3 billion on the entire drug sector ($23 billion total) which is more than what the memo says (page 214). If you do combine the $12 billion agreed to fee with the $9 billion agreed to savings from FOBs (which appear not to be in the bill) it is a total of $21 billion. Overall it appears that the internal memo uncovered by Grim very accurately reflects a secret deal Baucus and Obama cut with PhRMA.

I’m worried that at the last minute the GOP will deliver the votes to pass Max’s plan. Is this a realistic fear?

Nothing gets outta that committee if just two Democrats vote against it. The battle here is to get at least 4 of the Dems to stand together and nothing will come out unless it’s sane.
Thanks for the information but just how are we doing in the fight? And if Max’s plan fails what is the Senate Dem’s fall back position will they go with the House or propose another weak compromise?
Whenever I, as a conservative, get a little discouraged about how things are going for our side, I log on to FDL for a quick pick-me-up. And more times than not, you cheer me up. This is a fantastic site to watch liberal hari-kiri.

Max’s name will go down in history, only not the way he planned.
And why are we still permitting direct-to-consumer marketing? I thought that abomination would surely go away with health care “reform,” but no apparently not.
If Finance fails to report out a bill, can’t Harry Reid just schedule floor debate and a vote on the Kennedy bill? Then we’ll work it out in conference.

There is a possible step between committee and conference, it seems. Daniel Waldman over at Large Orange has a theory about how Rule XIV could be used to mash-up the HELP and Finance committee bills, plus anything else anyone wants to toss in or out. Apparently Diaper Dave’s craptastic anti-ACORN bill is already pushing the Rule XIV button — not done frequently due to its tendency to provoke the other side into retaliation. So Diaper Dave keeps on giving, but there is also danger that good stuff could get tossed and bad/worser stuff could get bolted in before the Senate vote.
Long way to go yet.
As a Montana progressive, I was first appalled by Max’s plan but that quickly changed to anger. Does Max think he can get re-elected in Montana if he forgets his Democratic liberal base? We need some ads here in Montana similar to the ads that were shown tonight on Rachel Maddow’s show targetting our blue dog Democrat Senators/Representatives within their states. We must have a public option–wasn’t that message clear with our election of Obama? By the way, I am not the only montana democrat–we almost pulled our state into the red zone last election…if the public health option fails, Montana will probably slip further into the blue…
I just joined Firedoglake. I am not sure what is going on. Our system of government sure seems like a hard way to accomplish anything. What do we do now to get a Public Option that people can afford that will cover every one? We don’t want to wreck Medicare. It does work for seniors. I am really sick of Republicans, and it looks like we might not be able to trust some of the Democrats. Pres. Obama was not my first choice as I did not know enough about him. I supported Hillary, as she is intelligent and knows the government. I think she is honest. I hope Obama is honest because we need him to be. We can’t give up on the Dems. They are all we have.
