The Election Contest has ruled, unanimously, for Al Franken. In a 68-page decision, the ECC kicks Norm Coleman’s equal-protection argument to the curb, pointing out that county officials must have some leeway when making decisions on how to hold elections. For instance, on Page 47, we have this:

The rest of the decision wasn’t any friendlier to Norm. And The UpTake notes that while the decision doesn’t say that an election certificate must be issued — they’re apparently leaving that to the Minnesota Supreme Court — it does say that Franken is entitled to it.

Don’t we love that Franken was part of the early day of Air America? Maybe we are seeing evidence that large swaths of our country would like to see some changes….Hey, W, stay in your cul de sac…you have done enough. Maybe SMU will want to rethink your theme park.
I started listening to AAR from the first day. Sadly there is little on the network now that I want to listen to. Rachel was the last holdout, but they are just playing the audio of her tv show now. It had such a promising start. And there are fewer and fewer progressive radio stations surviving. I have to stream one from Seattle and I live in PA. Again, the dems with the $$ don’t get it about supporting infrastructure for the long haul.
Just for Norm.
Amen. Wonder what sleazeball Norm and the even sleazier RNC have up their sleeves now. They seem to have a lock on amoral/immoral creativity. The nation and Minnesota need leadership, not political Machiavellianism.
what;s the worst case scenario as far as how long an appeal will take and then how long before we find out if they actually seat franken once the appeal is found in franen’s favor?
IIRC 10 days to file an appeal, then 15 more days for Al’s team to respond, then it’s anyone’s guess.

Ten days for Normie to file a notice of intent to appeal.
Fifteen days from the filing of intent for Normie’s lawyers to actually file their brief.
Fifteen days from Normie’s filing of his brief for Franken’s lawyers to respond.
I figure Normie will file his notice of intent on April 23, 2009. His argument will be filed May 8, 2009. Franken’s response will be filed May 9 or 10. The Minnesota Supreme Court will decline to hear the case and order Pawlenty and Ritchie to issue a certificate of election around May 12/13, 2009.
The Minnesota Supreme Court could save us all a great deal of trouble by requiring a 7 figure surety bond for the appeal.
I picked the Seattle station because it streams over iTunes which makes it easy.

Unfortunately Minnesota Governor and ultimate certificate-signer Tim Pawlenty is one of the dead-enders.
Felony convictions seem to be the best resume for radio wingnut welfare recipients.
Given that Coleman delays to the max legally possible (and he will) and goes federal (he might) the time variables are all on the judicial side and May or June is the most widely quoted ETA.
Pawlenty theoretically could try to aid the RNC stall by declining to issue Franken’s certificate when the MN supes tell him to… but it would cost him any chance of reelection.
As has been pointed out elsewhere the Fed supes will drop the case like a hot potato by denying cert because the last thing the RNC actually wants is any hint of real equal protection debate as far as elections are concerned. The ‘cons don’t do well with the concept of actual equality and fairness in elections at either state or federal levels.
That’s about it I think.
it’s an odd story. It seems that the guy who was behind AAR early on then went on to work with NovaM which had Mike Malloy then took on Randi when AAR canned her. He lost tons of his money in the downturn and reportedly became suicidal. Here’s the WSJ version.

my only quibble is with your verb tense.
I wonder if Norm’s spigot of money is going to keep flowing, this was a really one-sided decision that makes any further action extremely pointless. Sure, Coleman can always squeeze money out of the republican rubes, but the big money people (as well as the high-priced lawyers) may find they have better things to concentrate on.
but if like me, you see all this foot dragging as a means of obstructing Dems in Senate it behooves them to keep on keepin’ on. will be very interesting to see where the money for any further action beyond MN Supremes comes from

When Coleman has exhausted his state remedies, it will be truth or consequences time for Pawlenty — whether only one top level Minnesota republican politician will be destroyed by this fiasco or two.
The RNC’s money is on further delays to block Franken’s seating and therefore, two.

AAR sacked her long ago. Then she got picked up by a variety of stations who weren’t doing the whole AAR lineup anyway—I don’t think anyone is any more. Hard to know what will become of her as what’s left of the leftie stations aren’t exactly tearing up the airwaves. Even I find it hard to listen to some of them.

We’ll get to hear Franken again though in a very different venue and not on a daily schedule.
Strip-Search Sammy Alito is the SCOTUS justice assigned to Minnesota; he’ll want to make his bones with his Bush v Gore buddies. The moment the Minnesota Supremes rule, Norm’s lawyers will be in Sammy’s face for a stay to prevent Smiling Tim from signing the certification.
And Sammy will sign, to prove he’s One of Them.
Watch for it, it will happen.

(At that point Reid could actually do something right and seat Franken anyway after such an obviously partisan abortion of justice… so Reid will cave of course.)
So with Pawlenty given the cover of “They made me not sign!” (which won’t save him, I think) then how long could the fed supes stall on denying cert?

I cannot imagine that Mr (in)Justice Roberts could want anything to do with this decision. He knows that SCOTUS lost enormous credibility in Bush v. Gore. Meddling in a close State election for partisan purposes could cause enormous backlash, maybe even amending Section 50 of the United States Code and adding four or so justices to the Court. I can’t imagine that Roberts would want to risk that.
