Norm Coleman needs money, and needs it very badly, for his trials — both the current one and the looming Kazeminy trial in Texas. The prospect of a massive drop in online donations is absolutely toxic to his ability to sustain his election contest — so much so that he could be forced to drop his planned appeal to the Minnesota Supreme Court. (Of course, since such an appeal would be doomed anyway, Norm could use the lack of funds as a somewhat face-saving way of bowing out and simultaneously lobbing one last smear job at Franken’s legitimacy: "I woulda won, but the dirty hackers from the Franken campaign made my money dry up!") However, it looks like the drying up of the online money flow may actually be the least of his worries.
Item: David Schultz, a professor of election law at Hamline University in St. Paul, told TPM’s Eric Kleefeld via e-mail that Coleman is very likely in trouble for not immediately notifying the donors back in January of the security vulnerability.
Item: Minnesota law requires prompt notification of the persons and of consumer reporting agencies when the persons’ personal information was put at risk due to a security breach or vulnerability:
If a person discovers circumstances requiring notification under this section and section 13.055, subdivision 6, of more than 500 persons at one time, the person shall also notify, within 48 hours, all consumer reporting agencies that compile and maintain files on consumers on a nationwide basis, as defined by United States Code, title 15, section 1681a, of the timing, distribution, and content of the notices.
There are over 4700 people on Norm’s donor list. He knew about the vulnerability back in January. He didn’t do diddly. He’s in trouble.
Item: Credit card companies do not take kindly to merchants and vendors who store the three-digit security codes of their customers’ cards on any website. That is a flat-out data practices violation. It’s even more heinous if the information is stored unencrypted, as it is here. If the State and Federal authorities don’t take a pound or two of flesh from Norm, Visa and MasterCard sure will. Norm can scream "I wuz hacked!" as loud as he wants — the bottom line is that this information should not have been stored online in the first place. Period.
Item: Per Noah Kunin of The UpTake, when Norm Coleman or his people say that they’re off the hook because no inappropriate data access took place, they’re lying — and the screen shots exist to prove it.
As a Kossack who is also a merchant whose business depends on credit card usage said: "Coleman will be eating cat food after Visa and MasterCard get through with him."

It was my understanding that if he loses his case Coleman would have to pay all trial costs including Franken’s. In states I am familiar with he would have to post a bond before he could proceed to an appeal.

Of course, Norm would probably get a pass for smoking dope back in the 70s. Not taking measures to deal with a credit card security breach is, ahem, a bit more problematic.

Every single one of those donors will require new cards, new card numbers, account monitoring and free credit reporting for some time. I don’t think VISA, MasterCard, AmEx, & Discover want to pay for that if there’s an easily identifiable culprit who flagrantly avoided doing the right thing by reporting the breach when discovered, as required by law and card merchant agreement.
Me, I’m stocking up on popcorn.
I’m wondering if Coleman stalled reporting this precisely to ensure that they received the money on THEIR Credit Card transactions? If they had notified VISA, MC. AMEX and the donors of the chance of their numbers being available for fraudulent use because of the Coleman Campaign errors…many of those donors may have cancelled their contributions.
Certainly the Credit Card firms would have slowed down release of transacted payments until they could assess when the site was compromised and if any fraudulent usage had occurred. For them it would be a real mess, establishing when and for how long transactions were subjected to this risk. Each subsequent legitimate transaction would have to be confirmed.
There might be fees and charges to the Coleman campaign for violations of the merchant agreement. If it results in someone who is actually defrauded it could amount to tens of thousands of dollars in fines, or civil damages. Similarly anyone whose credit rating was damaged or were saddled with fraudulent charges might sue the Coleman campaign, as well.
After eight years of having to deal with this scum sucker as my mayor, I can’t tell you how sweet it feels to watch karma’s grand piano come down on Coleman. He’s lived his life pushing cut-rate, self-serving agendas surrounded by goons who make insurance salesmen look like George Bailey.
I’d feel sorry for the people who’s credit cards were exposed if it wasn’t for the fact that they were helping Coleman fuck up Franken’s election, and I just can’t wait to see how he plays the fade-out. It will be a turn-away, can’t bear to look embarrasment.
I’m SURE that they didn’t inform the donors of the breach because they didn’t want to screw up the flow of contributions. Guys like Coleman NEVER think they’re going to get caught until the spotlight hits them.

I’ve had my “security” breached several times. Each time I was not only advised via a letter, but I was provided with redress in the form of a security monitoring service for a year if I wanted it.
This is gonna cost a whole lot! The cost of the letters. The cost of paying for the security of their credit files for at least a year. And all the litigation this will spawn!

I can’t help but wonder why Coleman’s site kept the security codes. It’s explicitly forbidden and the only reason I can think of keeping them is to be able to run future transactions without the cardholder’s involvement. In other words, running up bogus charges.
I’d worry about having money stolen by Coleman as much as anyone, were I donor.
Anyone want to bet that, in typical Republican fashion, Coleman hired a crony to handle his IT? Like maybe his out-of-work cousin, who knows MS Word, or someone one of his friends knew, who could spell I-T?
What’s even better is that the Coleman’s campaign’s stated policy used to be to NOT keep the credit-card info!
Oh, and it gets better: Norm actually sponsored legislation back in 2007 that, if passed, would have made it a Federal (and not just a state) crime for him to do what he did.

Loved this post! I have been following this issue along with everyone else, but the open credit card information and the 3-digit security codes is beyond belief!! I work in IT, and the lack of security violates every principle for safe transactions. Someone commented above that maybe Coleman would become liable for any fraudulent activity… I would think that the credit card issuers and banks would go after him to cover the costs of opening new accounts and transferring funds, etc. because of the stupidity and lack of security. I would dearly love to understand why he kept all the information together. Perhaps it was to save money — and it was SO DUMB!!

The sad thing about this is that many of those on Norm’s donor list are not blaming Norm, but saying that it was a Franken dirty trick. And that makes absolutely no sense. Did Al Franken hold a gun to the head of Coleman’s IT guy making him store the donor data in an unsecured directory on the internet and even making sure that the whole cc number and three digit code were included?
Conservatives are so deluded. They are totally incapable of admitting that they or any of their ilk ever makes a mistake.
