Geez, no wonder Bogus Ben Ginsberg looked and sounded dispirited in his afternoon presscon today. Not only did the Minnesota Supreme Court last week hand down a decision that deep-sixes the GOP/Coleman strategy of looking to the Federal courts for relief on appeal, but today Team Coleman’s hopes of getting the ballot universe expanded with more votes for Coleman just got a swift kick in the ass, as the ballots he was counting on from pile 3a evaporated upon examination:
Republican Norm Coleman had hoped an inspection of secrecy envelopes holding rejected absentee ballots would yield enough additional votes to help him cut into Democrat Al Franken’s 225-vote lead. But only 89 of roughly 1,600 inspected envelopes contained valid registration that might allow the ballots to be counted.
Even if every single one of those 89 ballots was a Coleman ballot — and two-thirds of the remaining pile 3as come from counties that Coleman won last November – that’s less than half of what Norm needs to catch up to Franken, much less overtake him.
Remember last week when we saw that Franken’s lead attorney, Marc Elias, was telling us that the amount of actual, provable, countable ballots that was in the thousand-plus rejected ballot pile that Coleman wanted counted was in the dozens? Guess what – Elias was right. Again. And with his effort to argue the existence of hundreds of "Rule 9" duplicate ballots shot down, there’s not much Norm can do to alter the existing ballot universe at all, much less shove it around enough to give him a win. (They must realize this too, because they’re really amping up the "do-over" talk when they know full well it ain’t gonna happen.)
Suddenly, that Motion to Dismiss that Team Franken filed — predicated on the claim (based in part on Bell v. Gannaway) that there’s no way Coleman can find enough countable ballots to overtake Franken’s lead — is looking a lot stronger. As Kossack seesdifferent points out, Norm’s people had been planning on perhaps 700 countable ballots to come out of Coleman’s 3a pile. Instead, he got less than ninety. The Election Contest Court might still deny this motion, just to deny Coleman the chance to holler "we wuz robbed!" (which they’re yelling anyway), but the factual basis of Coleman’s case is turning out to be gossamer and moonbeams and horsepucky.
Hang tight, folks: This is all over bar the shoutin’, and the shoutin’ may be over even sooner than I’d hoped.

Well, Harry Reid has set an April 1 deadline. The odds of making it just improved markedly.
At the very latest, Franken will likely be seated right after the Easter recess, just in time for Stimulus II and/or the omnibus budget bill.
How does Reid get to set a deadline on Minnesota’s recount? Or is he going to seat Franken if the court is still dallying?
My guess is that Reid’s been in contact with Franken and his team, and they probably told him that this thing should be wrapped up soon.

Why in the world are we allowing the perpetrators of the health care crisis to set the terms of the debate on how to clean up their mess?
Join nurses, doctors, and health care activists Tuesday for a day of calls in Congress and a protest against the insurers as we convey a different message.
1- A national call-in day to Congress. Remind the legislators that we need more care, not more private insurance. Urge them to make sure single payer/Medicare for all is a central part of the health care debate. Ask them to support HR 676, the bill to expand and upgrade Medicare to cover everyone. Find information for your US Representative and Senators at http://www.votesmart.org.
You can also send them your insurance bill or your insurers’ letter of denial for needed care to help them recall why we need to get the insurance companies out of the way. Anyone who follows the national healthcare discourse might well conclude that the foremost task is to draft a plan that appeals to the insurance industry, along with the drug companies, and the other corporate lobbyists.
You might almost conclude that they own the building. Or maybe they’re just paying the rent.
As the Washington Post reported Sunday, in data compiled by the consumer advocacy group Consumer Watchdog:
Health insurers and drug makers have showered members of the 111th Congress with millions in campaign contributions over the last four years, with a special focus on leaders who will play major roles in shaping health-care legislation….
The health-care sector has long ranked with financial services and energy interests as one of the most powerful political forces in Washington, and it spent nearly $1 billion on lobbying in the past two years alone.
The third highest beneficiary in the Senate is Sen. Max Baucus, who as head of the Finance Committee has made himself a kingmaker in the healthcare discussions.
The same Max Baucus who tells every audience that will listen that single payer is off the table and we need a “uniquely American solution.”
April 1 sounds quite appropriate. I hope Senator-elect Franken skips across the finish line in style because, darn it, he’s worth it.
Franken will be in the Senate in time for the EFCA vote. Hooray!

I have no doubt they will hold off on EFCA until Franken is indeed in the Senate. They need the vote (for cloture anyway), and there’s no question at all that Franken will support it.
