Day Seven of the Coleman contest trial of the recount, and here are some notable things therefrom:
– Local Coleman team lawyer Tony Trimble was released from whatever dungeon the out-of-state Pros from Dover tossed him and Fritz Knaak in, and actually allowed to speak in court — for about two minutes or so, right after the lunch recess.
– Franken attorney Keith Hamilton then appeared and cross-examined a Coleman voter who had submitted an absentee ballot with non-matching signatures, for which it was rightly and legally rejected, but which Coleman thinks should be counted. Under cross-examination, the witness revealed that she later went on to vote in person anyway, which is legal in Minnesota — the vote cast in person is counted and the absentee ballot ignored. (Remember, Team Coleman’s been whining about allegedly double-counted ballots allegedly benefitting Franken all through this. Oh, the irony!)
– Oh, and Team Coleman just dropped their challenge against the 933 fifth-pile (that is, wrongly rejected) absentee ballots that, when they were finally counted last month, turned Al Franken’s 49-vote lead into a 225-vote lead. (As Eric Kleefeld points out, these were also ballots that the Coleman team had agreed to count during the negotiation of the fifth-pile ballot counting rules.) That’s pretty huge, and a sign that the Coleman team knows it’s doomed on the merits.
– Meanwhile, the judges of the Election Contest Court bounced Coleman’s attempt to muddy the waters by counting all 11,000-odd rejected absentee ballots. Instead, they have "narrowed the universe" and identified around 4,800 of these rejected absentee ballots that they will allow to be reviewed for what will be a third time; this is more than what the Franken campaign wanted to see — and really, they have a point as these ballots have already been legally rejected twice — but the ECC is being relatively nice to Coleman so as to keep him from having any legitimate rationale for appeal.
So why are they fighting on? In part, to cause fear, uncertainly and doubt over the recount process, in the hopes of getting a do-ver — even if it means sliming the reputations of tens of thousands of local, county and state elections officials and state judges, including the ones of the Minnesota Supreme Court. But it’s also to make it harder for the Democrats to get the stimulus bill passed, which seems to be their top priority now. But this might be all for naught, as State Representative Phyllis Kahn (DFL-Minneapolis) has a bill before the Minnesota House that would compel the Secretary of State and Governor to sign Franken’s election certificate, thus allowing Franken to be seated. Pawlenty would veto it, but there is a chance, albeit slim, that the DFL might be able to peel off enough Republicans to override a Pawlenty veto; even Minnesota Republicans have got to be increasingly upset that we only have one Senator allowed to represent us right now.

Of course he has a chance. The courts will likely hand him the Senate seat. That’s what he’s hoping for and that’s what he’ll likely get. The SCOTUS of the U.S. gave him the precedent to be optimistic. The Repukes will draw it out until the courts rule in his favor.
You know Coleman is making Dino Rossi (R), candidate for Governor in Washington State, look ethical and competent. I hope the courts in Minnesota continue to follow the law and get this thing over with.
GAHhhhhh! He just won’t go away. Coleman is like bad State Fair food that keeps reminding you of its presence long after you thought you were done with it … rancid, that’s what Normie is.

What a wonderful way to keep the Dems from the possibility of their super majority. Which now is even farther out of reach with the Gregg weirdness.
Obama had an opportunity of a super majority with the Gregg appointment to Commerce but a deal was struck with the Democratic governor that insured a Republican appointment. Either Obama is a chump or party labels mean nothing to him. In that case one can only conclude that he’s nothing more that a “Corporatist.” When will the U.s. have a trully progressive revolutionary party?

A good and fair question. I know that Obama isn’t stupid. I am assuming that he isn’t a treacherous viper. Which leaves me somewhat slack-jawed, trying to figure out what game is afoot here. I’m not politically astute enough to hazard a guess. That’s why I hang out here, trying to make myself, ummm, astuter.
Judging from the (mis)appointments he’s made, I’m betting on Corporatist. Still, the pukes are doing a good job of punking him too.
barbara, you are a wise woman and you’ll learn much here, as have I. Nonetheless I’ve been around the block a time or two to know that unless Americans keep the pressure on the corporatists and fascists will defeat the will of the people. After all they own the corporate media.
We aren’t screaming because we’re in survival mode, trying to outlast subzero weather! Okay, that and political overload. IMHO, Minnesotans and probably others are fed up and rising with the 2008 election that was preceded by two years — two YEARS — of rising rancor and invective hurling and dirty tricks and insults, and those were the good things!

and finally, assumptions about the intentions of people we’ve never met and don’t know are problematic, especially when involving politicians. ymmv, of course, but obama has been sold to us via a brilliant marketing campaign. we know the image – we have no idea about the person.

Corporate media brings up another thing for another time, i.e., the terms of current FCC members. Right now, there’s a 3-2 split in favor of the pugs. Everything is politicized. Ev-ery-thing.

Seriously, I don’t know. I was in and out of “storm the Bastille” mode over the past few years. And by and large, the message back was, “chill, barbara.” And the Obama meme was, “These are very smart people and they know what they’re doing. Be patient.” Pat, pat, pat.
So I’m trying to learn patience. It does not come easily.
It will be very telling who Obama nominates to lead the FCC. I’m just hoping it’s not another Republican but then I guess I wouldn’t be surprised. After all Obama has appointed more members of the opposition party to his cabinet than any President in history. They would like us to believe that is “change we can believe in.” Right!

The whole reason this contest hasn’t been summarily thrown out is because the judges want to make sure it never comes back. They could have shut it down last week when Norm’s people pulled that stunt with the ballot photocopies, but they don’t want to give Norm even the ghost of a rationale for a successful appeal.
Okay, so the judges are dotting every “i”, crossing every “t” and leaning over backwards so Normie can’t say he didn’t get his chance. When do we get a ruling?
Because it’s as clear as the gibbous moon on this chill New Mexican night that Normie is going to appeal the thing. God and the Rethuglican string-pullers only know why he’s going to appeal, but he’s going to.
